Beat Battle Game (beat-battle.net)
Operated by M9 Media LLC d/b/a Beat Battle Game.
M9 Media LLC (“M9 Media,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of Beat Battle Game (the “Service”) to do the same. This DMCA Policy explains how copyright owners can submit takedown notices for content on the Service and how users whose content has been removed can submit counter-notifications.
This Policy is incorporated by reference into our Terms of Service.
1. Notice of Copyright Infringement
If you are a copyright owner (or authorized agent) and you believe in good faith that material on the Service infringes your copyright, you may submit a written notification to our Designated DMCA Agent at the address in Section 4. To be effective under the Digital Millennium Copyright Act (“DMCA”) (17 U.S.C. § 512), the notification must include all of the following:
- (a) a physical or electronic signature of the copyright owner or person authorized to act on the copyright owner’s behalf;
- (b) identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works);
- (c) identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — including URL(s), screen captures, or other identifying detail;
- (d) information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address;
- (e) a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Counter-Notification
If you are a user of the Service whose content has been removed pursuant to a DMCA notice and you believe in good faith that the content was removed as a result of mistake or misidentification, you may submit a written counter-notification to our Designated DMCA Agent. To be effective, the counter-notification must include all of the following:
- (a) your physical or electronic signature;
- (b) identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed;
- (c) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- (d) your name, address, and telephone number; and
- (e) a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which M9 Media may be found), and that you will accept service of process from the person who provided notification under Section 1 or an agent of that person.
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that we may replace the removed material or cease disabling access to it in ten (10) business days unless we receive notice that the complainant has filed a court action seeking to restrain the alleged infringement. We may then replace the removed material or cease disabling access between ten (10) and fourteen (14) business days following our receipt of the counter-notification.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4. Designated DMCA Agent
Our Designated Agent to receive notifications of claimed infringement is:
- Agent Name: Ashwin Khurana
- Organization: M9 Media LLC
- Address: 5900 Balcones Dr Ste 100, Austin, TX 78731
- Email: [email protected]
- Phone: +1 (956) 910-9096
Our Designated Agent is registered with the U.S. Copyright Office; the registration can be searched at https://www.copyright.gov/dmca-directory/.
5. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents (a) that material or activity is infringing, or (b) that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner, the copyright owner’s licensee, or M9 Media LLC.
Do not submit a false notice of infringement. Do not submit a false counter-notification.
6. Contact for Non-DMCA Copyright Concerns
If you have a copyright concern that does not rise to the level of a DMCA notice (for example, you would like to discuss a licensing arrangement, request attribution, or have a question about the use of your work on the Service), please contact [email protected] or open a support ticket on our official Discord server at https://discord.com/invite/beatbattle.
Important: Formal DMCA notifications under Section 1 and counter-notifications under Section 2 must be sent to the Designated Agent at the address in Section 4. Discord support tickets are not a valid channel for formal DMCA notices, as they do not satisfy the documentation and verification requirements of 17 U.S.C. § 512.
